Please read these Terms and Conditions carefully before ordering any Products from the Site.
By ordering any of our Products, you agree to be bound by these Terms and Conditions.
1. Who We Are?
We are Hup Hong Machinery (S) Pte. Ltd.,(Reg. No. 198600775E), trading as www.diytools.sg (“DIYTOOLS.SG-Trademarked”).
2. Definitions in our Terms & Conditions:
a. “You” or “Customers” refers to any individual who places an Order in our site;
b. “We” or “Us” refers to DIY TOOLS.SG or Hup Hong Machinery (S) Pte Ltd.
c. “Account” refers to DIY TOOLS.SG Account that you have registered on our site;
d. “Order” refers to the order submitted by you through our site to purchase a product.
e. “Contract” refers to your Order of a product or products in accordance with the Terms & Conditions stipulated in herein which we accept.
f. “Order Confirmation” refers to our email to you, acknowledging our receipt of your order. Any use of the above terminology or other words of similar meaning, in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.
3. Eligibility of Use
To place an order in DIY TOOLS.SG, you must be over eighteen (18) years of age. You may seek the help of an adult to help in your purchase.
4. Private & Confidential Statement
We place great importance in protecting customers privacy and information collected in the process of registering and ordering from our site. Only authorized employees will have access to these information. We do not allow third party to have access to these information, except in the case of legal requirement by relevant authorities. Any emails sent by us will only be for the purpose of provision of agreed services and products, or for any updates or campaigns. We will constantly be developing stringent process to ensure that our customers’ personal data is well protected.
We forbid any user of the site to transmit any kind of technological virus that will cause harm to our system and our users’ system, corrupt data, cause disturbance to another user, post offensive, abusive language or pictures, infringe propriety rights, send irrelevant material e.g. advertisement, hack into any aspect of our data and system, whether to cause harm or not. We will take serious action against such act through the relevant law enforcement authorities.
6. Disclaimer of Liability & Limitation
DIY TOOLS.SG and its employees shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of this site and any materials posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise.
The information on this website is provided on an 'as is' basis. It excludes all representations and warranties relating to this website and its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this website and/or the Company's literature.
The above disclaimer and limitation apply only to the extent permitted by law. None of your statutory rights as a consumer are affected.
7. Customer Satisfaction
DIY TOOLS.SG and its employees placed customer satisfaction as our priority. You may contact us at any time using the contact details given. We will address your concerns and questions as soon as possible. In any case, where there is a complication in the enquiry, we may take a longer time to respond.
8. Circumstances beyond our control (Force Majeure)
We shall not be liable to you for any breach, hindrance, termination or delay in the performance of a contract attributable to any cause beyond our control, including but not limited to any Act of God, terrorism, war, political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man-made eventuality.
We reserve absolute discretion on the solution we adopt in fully meeting our obligations under the Contract despite the Force Majeure Event.
We reserve the rights to amend these Terms and Conditions at any time. All amendments to these will be posted online. However, the continued use of the site will be deemed to constitute acceptance of the new Terms and Conditions.
In the event when a notice is given in writing through either letter or emails to the relevant party at the address or email addresslast known to the other, it is considered to have been served within 2 business days from the day being sent.
10. Governing Law
These Terms and Conditions shall be governed and construed in accordance with Singapore Law. Both we and you hereby submit to the non-exclusive jurisdiction of the Singapore Courts.
- We aim to deliver the product to your stated address in your order and delivery time indicated by us at a period of 3 to 4 days, or otherwise stated.
- We will notify you if we are unable to meet our estimated delivery schedule. Should there be any disruption to the delivery, we shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses arising out of late delivery.
- You may contact us via email here if there is any problem with your order.
- We are unable to delivery to some location due to restrictions and limitations. Please refer to our Non-Delivery Zone to find out more.
- All risk in the product shall pass to you upon delivery.
- In the event when no one is around to accept the delivery, and should you choose to have our delivery man leave the package at your door, with your neighbour or anyone else or other arrangements, the risk will be pass to you once our delivery man part with the item. We will not be liable for any mishap to the package.
- If you are not available and not contactable, you can either request for self pickup at our pickup location or arrange for re-schedule at a delivery fee of $10.00. Any delivery fee paid previously will be not be refunded.
12. Cancellation by Customer
If you wish to cancel your order, please contact our Customer Service via email here or messenger. We do not allow cancellation of order once the order has been dispatched.
13. Exchange & Return Policy
Exchanges are only available for faulty product or wrong product delivered.
Here are the steps to exchange:
Step 1: Take pictures of the faulty or wrong product.
Step 2: Upload the pictures in our contact form here.
Step 3: Fill up your details and write to us about the problem. Upon receiving your feedback, we will get back to you at the soonest on the exchange.
Our products are non–refundable once it is sold.
14. TERMS OF SALE
To place an Order, you can either register an Account with us or order as a Guest. You must only submit to us information which is accurate and true. You shall not misuse the Site by creating multiple user accounts.
14.2 Formation of a Contract
- No Contract in respect of any Products shall exist between you and us until we have shipped the Products to your address.
- To submit an Order, you will be required to follow the online shopping process on the Site. After this, you will receive an Order Confirmation which will act as an acknowledgement of your Order.
- An Order is only considered accepted by us upon your Order being shipped to the delivery address provided by you.
- A Contract will relate only to those Products which we deliver to you. If your Order consists of more than one Product, the Products may be delivered to you in separate packages at separate times.
14.3 Price and Payment
Whilst we make best efforts to ensure that all details, descriptions and prices which appear on this Site are accurate, there may be instances where errors may occur. If we discover an error in the price of any Products which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your Order at the correct price or cancelling it. If we are unable to contact you we will treat the Order as cancelled. If you cancel your Order before we have shipped it to you, and you have already paid for your Order, you will receive a full refund.
(a) Where applicable, prices are inclusive of GST and are in Singapore Dollars. Delivery costs will be charged in addition where applicable; such additional charges are clearly displayed and included in the ‘Final Total’.
(b) We are under no obligation to fulfil your Order if the price listed on the website is incorrect (even after your Order has been acknowledged by us).
(c) You can pay using any of our payment options listed on our “Types of online payment page”.
(d) To minimise the risk of unauthorised access, we encrypt your card data. Once we receive your Order we will request pre-authorisation on your card to ensure there are sufficient funds available to complete the transaction. The order will not be confirmed until this pre-authorisation check has been completed. Your card will be debited once we have sent you the Order Confirmation. Cards are subject to validation checks and authorisation by the card issuer. If we do not receive the required authorisation, we will not be liable for any delay or non-delivery.
(e) Upon authorisation of the payment, by clicking the “Order now” button you are confirming that the card belongs to you or that you are the legitimate holder of the promotional voucher, and have sufficient funds or credit facilities to cover the cost of the Product.
14.4 Mistaken Orders
If you discover that you have made a mistake with your Order after you have submitted it to the Site, please contact us immediately. We will try our best to process your request.
14.5 Refusal of Order
We reserve the right to withdraw any Products from this Site at any time and/or remove or edit any materials or content on this Site. We will make our best efforts to always process all Orders but there may be exceptional circumstances wherein, we may need to refuse to process an Order after we have sent you an Order Confirmation, which we reserve the right to do at any time, at our sole discretion.
If we cancel your Order and you have already made payment for your Order, the payment amounts will be fully refunded to you.
We will not be liable to you or any other third party by reason of our withdrawing any Product from this Site, whether it has been sold or not, removing or editing any materials or contents on this Site or for refusing to process or accept an Order.
